Adopted by the Central Committee of the Libertarian Party of Santa Clara County, 24 January 2026:
Whereas, the Libertarian Party has always proudly defended the rights of individuals regardless of their place of birth;
Whereas, the Libertarian Party holds that whatever government action may be justified must always be done in a manner that respects individual rights, including non-initiation of force and due process;
Whereas, to whatever extent use of force by the federal government to control the crossing of borders by people or goods may be needed, it should be used only at the border, not in our neighborhoods, workplaces, and schools;
Whereas, when any government action to deal with real crimes, including apprehension of alleged criminals, may be necessary, that action is properly the province of local law enforcement agencies, with other levels of government only playing a supporting role when local agencies require and request assistance;
Whereas ICE is operating contrary to all of these principles, at the direction of a president pursuing a political agenda, endangering both the lives and rights of citizens and non-citizens alike, as well as blurring the distinction between military and police both within government and among the people at large;
Whereas mere reform or additional regulation of ICE cannot address these fundamental problems, and cannot provide assurance that some future president will not also make use of such an agency to pursue his or her own political goals;
Therefore, the Libertarian Party of Santa Clara County
Calls for the immediate withdrawal of all ICE personnel from Santa Clara County, and
Calls on the representatives from Santa Clara County in Congress to sponsor and enact legislation to disarm, defund, and abolish ICE and repeal all existing legislation that may be interpreted as allowing the President to authorize similar behavior within our community by any other federal agency.
